Filing a Subdivision or Development Appeal

Grounds for an Appeal

You can appeal a Development Officer's decision if

  • Your application for a development permit has been refused
  • Your application for a development permit was approved with conditions that are unacceptable to you
  • If a development authority refuses or fails to issue a development permit to you within 40 days of receipt of the application
  • You have been issued an order directing you to stop construction or stop the present use of your property
  • You will be affected by a new development, or new use of someone else's property

You can appeal the Subdivision Authority's decision if

  • Your application for a subdivision has been refused
  • Your application for a subdivision was approved with conditions that are unacceptable to you
  • If a subdivision authority fails or refuses to make a decision on an application for subdivision approval within the time prescribed by the Subdivision and Development Regulations

Filing an Appeal

Before filing an appeal, talk to your neighbours and consult the Development Officer or Subdivision Authority to ensure that you have all the information about the proposed development. SDAB staff are available to answer questions about the appeal process. If you require further assistance, it is recommended that you seek legal advice.

To appeal a decision, you must submit a completed appeal form online, in person, or by mail and pay the required appeal fee within 14 days of receiving notice of the decision.  There is an appeal form available from the Office of the City Clerk.  If an appeal arrives after the 14 day deadline, the Board will decide whether or not it has the right to hear the appeal.

Appeal Fees

Development appeal fees are $37 for any development, except signs, proposed on lands governed by the following land use zones:

  • RF1 Single Detached Residential
  • RF2 Low Density Infill
  • RF3 Small Scale Infill Development
  • RF4 Semi-detached Residential
  • RMH Mobile Home
  • RSL Residential Small Lot
  • AGU Urban Reserve
  • RPL Planned Lot Residential
  • RR Rural Residential
  • AP Public Parks
  • AG Agricultural
  • A Metropolitan Recreation

Fees are $72 for signs, subdivision appeals, direct control districts, stop orders, and all other zones not listed above.

The appropriate fee must accompany your appeal or it is not considered complete and will not be processed.

Appeal fees may be paid using VISA, Mastercard or Debit but only if you file your appeal in person at the Subdivision and Development Appeal Board office. Cheques are made payable to the City of Edmonton.
